General terms and conditions applicable
Article 1 General
1.1 The general terms and conditions apply to all agreements regarding orders between Echt & Puur, hereinafter: bioromania.nl online store, and the customer, hereinafter: the other party.
1.2 The online store bioromania..nl is registered at the Chamber of Commerce under the name Echt & Puur with no Chamber of Commerce number: 94389969
1.3 The Bioromania.nl webshop has the right to change these general terms and conditions and the content of the online shop at any time.
1.4 By placing an order, the other party agrees without reservation to the general terms and conditions.
Article 2 Prices and our Products
2.1 The prices stated for the items are expressed in euros including VAT, but excluding transport or delivery costs
2.2 The bioromania.nl web store is not responsible for the consequences of typing and/or programming errors in the online store.
2.3 No rights may be derived from unlawful price information.
2.4 The descriptions given for the product regarding the taste, color and properties of all edible products are indicative and try to approximate reality as much as possible. However, since these are natural products, there can always be some deviation. Therefore, no rights can be derived based on the product description.
2.5 BIOROMANIA.nl strives to keep the product photo as up-to-date as possible. However, the product may always have some deviation from the delivered product.
Article 3 Payment and Cancellation
3.1 Payment is made without additional costs via iDEAL, bank transfer or bank transfer, Belfius or KBC/CBC or any other methods available on the website In addition, additional payment costs can also be chosen for Paypal or Klarna payment.
3.2 Payment for the order is normally made in advance. The order will be shipped only after payment has been made in full.
3.3 Subsequent payment is possible at additional payment costs through the Klarna platform
3.4 An order that has not yet been paid for and/or has not been shipped can be canceled if contacted in time. However, administration costs are involved. These costs are €2.50. If the other party has opted for payment via Klarna or Paypal, the additional payment costs will not be refunded.
Article 4 Delivery and Delivery
4.1 After placing an order on the bioromania.nl webshop, the other party will receive an order confirmation by e-mail containing an overview of the items ordered and the details of the delivery address. If the inspection shows that there are inaccuracies, the other party has a maximum of half an hour after receiving the order confirmation to contact the bioromania.nl webshop to report this. 4.2 The bioromania.nl web store outsources home delivery of orders to DHL DPD OR PostNL. The BIOROMANIA .nl webshop strives to have your orders delivered to you in the Netherlands within 3 working days of receiving payment.
4.3 The bioromania.nl webshop endeavors to deliver orders in Belgium/Germany within 5 working days of receipt of payment.
4.4 The webshop bioromania.nl will do its best to ship and receive the accepted order within the above period. If the delivery is delayed, the other party can stay informed via Track & Trace sent by e-mail.
4.5 When ordering, the other party agrees to the shipping rates as they appear in the total order.
4.6 The webshop bioromania.nl makes every effort to meet the deadlines it applies (including, but not limited to, the delivery time of a shipment or the delivery time of a shipment). However, these terms are indicative and not binding. If any of these periods are exceeded, Webshop bioromania.nl will not default.
4.7 Deliveries that are delayed during the shipping process are not the responsibility of bioromania.nl and constitute force majeure. The other party may never cancel this shipment in case of force majeure until delivery of the shipment.
4.7 Webshop bioromania.nl reserves the right to return the shipment in case of disputes during the shipment and to refund the other party the amount of the purchase minus the shipping costs.
4.8 The other party is responsible for providing correct information required for delivery of parcels, including Name, Address, Number, Postal Code, City, Country of Delivery, Email Address and Telephone Number. If you fail to provide the correct address and communication information, packages cannot be delivered or communicated. The bioromania.nl webshop is never responsible for incorrect data and any resulting additional postage costs will be charged to the other party.
4.9 PostNL DHL OR DPD will deliver the package to the other party’s home address. If you are not at home, the package will be delivered to your neighbors or delivered to a nearby collection point. Communication in this sense takes place exclusively by e-mail.
4.10 If the other party does not pick up the parcel from the pick-up point on time, the shipment will be returned to BIOROMANIA.nl. Responsibility for this shipment rests with the other party. As soon as the package has been received back at BIOROMANIA.nl, the customer will be contacted and the purchase amount minus the return costs of EUR 7.35 will be refunded to the other party’s account.
Article 5 Returns
5.1 As a consumer, the other party has the right to return non-food products. If a non-food item does not meet the other party’s expectations, you may return the item unopened and unworn.
5.2 Shipping costs as well as shipping risk for returns are at the expense of the other party.
5.3 The following conditions apply to returns:
– After delivery, the other party has 14 days to return the non-food products.
– After this 14-day period, the purchase cannot be canceled and is final.
– Non-food products must be returned in their original condition, i.e. undamaged, unopened and in the original packaging. The shipping packaging can be opened to view the item. However, if the item is damaged due to careless handling, the item cannot be returned.
– Food products can only be returned if a damage or defect is found upon receipt. The other party must perform a check on the day of receipt and inform BIOROMANIA.nl within 1 working day by e-mail at contact@bioromania.nl.
– The amount paid by the other party for the product will be refunded as soon as the return shipment has been received without defects at the BIOROMANIA.nl online store.
5.4 How to return a package?
– The other party takes a photo of the product they are unhappy with and then carefully packs it in its original packaging.
– The other party will request that a reputable shipping company deliver the parcel back to the BIOROMANIA.nl online store p/a, as described in article 1.2, at its expense.
– The other party bears the transport risk during the return transport. If the returned product arrives at BIOROMANIA.nl damaged, the other party will bear the costs.
5.5 Financial management of returns. As soon as we receive the return package, we will check that it is complete and undamaged. After this evaluation, BIOROMANIA.nl will refund the purchase price of the products to the other party or send a replacement product. Please note: If the other party received free shipping upon purchase, shipping costs will still be charged to the customer upon refund!
Article 6 Stock
6.1 Each item states whether it is in stock. If it is not in stock, the other party will be notified by the online store bIOROMANIA.nl.
6.2 Webshop BIOROMANIA.nl reserves the right to refund the amount paid by the other party and not to deliver if the ordered product is not delivered.
Article 7 Force majeure
7.1 Webshop BIOROMANIA.nl is not obliged to fulfill any obligation towards the other party if it is prevented from doing so as a result of a circumstance that is not due to fault and neither by law, nor by a legal act or the prevailing opinions in the traffic are its responsibility .
7.2 Force majeure in these general terms and conditions means, in addition to what is understood in this sense in law and jurisprudence, all external causes, foreseen or unforeseen, over which the online store BIOROMANIA.nl has no influence, but as a result of which the Store online BIOROMANIA.nl is unable to fulfill its obligations. Webshop BIOROMANIA.nl also has the right to invoke force majeure if the circumstance that prevents (further) performance of the agreement occurs after webshop BIOROMANIA.nl should have fulfilled its obligation.
7.3 The BIOROMANIA.nl web store may suspend the obligations arising from the agreement during the period during which the force majeure continues. If this period lasts more than two months, each party is entitled to terminate the contract, without the obligation to compensate the other party for damages.
7.4 If, at the time of the occurrence of force majeure, the BIOROMANIA.nl online store has already partially fulfilled its obligations under the contract or will be able to fulfill them, and an independent value is attributed to the part fulfilled or to be fulfilled, the online store BIOROMANIA .nl is entitled to a part that has been fulfilled or to be fulfilled must be invoiced separately. The other party is obliged to pay this invoice as if it were a separate agreement.
Article 8 Liability
8.1 If the BIOROMANIA.nl online store is responsible, this liability is limited to what is regulated in this provision.
8.2 The BIOROMANIA.nl webshop is not responsible for damages of any kind caused by the BIOROMANIA.nl online shop based on incorrect and/or incomplete information provided by or on behalf of the other party.
8.3 The BIOROMANIA.nl web store is only responsible for direct damages.
8.4 Direct damages are understood exclusively as:
The reasonable costs of determining the cause and extent of the damage, to the extent that the determination relates to the damage within the meaning of these terms; any reasonable costs incurred to ensure that the defective performance of the BIOROMANIA.nl online store complies with the agreement, to the extent that they can be attributed to the BIOROMANIA.nl online store; reasonable costs incurred to prevent or limit damages, to the extent that the other party demonstrates that these costs led to the limitation of direct damages, as referred to in these general terms and conditions.
8.5 The BIOROMANIA.nl webshop is never responsible for consequential damages, including indirect damages, lost profits, lost savings and damages caused by business or other stagnation. In the case of consumer purchases, this limitation does not extend beyond that permitted under Article 7:24 paragraph 2 of the Dutch Civil Code.
8.6 If the online store BIOROMANIA.nl is liable for any damages, the liability of the online store BIOROMANIA.nl is limited to a maximum of three times the invoice value of the order or at least to that part of the order to which the liability relates.
8.7 The liability of the online store Honingonline.nl is in any case always limited to the amount of the payment from its insurer, as the case may be.
8.8 The limitations of liability included in this article do not apply if the damage is due to intent or gross negligence on the part of the BIOROMANIA.NL online store
8.9 The BIOROMANIA.nl web store can never be held responsible for an allergic reaction to any of the items purchased by the other party in the store or online store. The other party has been sufficiently informed that it concerns a bee product and therefore its use is at its own risk.
Article 9 Prescription period
9.1 Without prejudice to statutory limitation periods, the limitation period for all claims and defenses against the BIOROMANIA.nl online store and third parties involved by the Bioromania.nl online store in the execution of an agreement is one year.
9.2 The provisions of paragraph 9.1 do not apply to legal claims and defenses based on facts which would justify the claim that the delivered item is not in accordance with the contract. Such claims and defenses expire two years after the other party has informed the Bioromania.nl online store of such non-compliance.
Article 10 Transfer of risk
10.1 The risk of loss, damage or depreciation passes to the other party when the goods are brought into the control of the other party.
Article 11 Compensation
11.1 The other party indemnifies the Bioromania.nl online store against any claims by third parties who suffer damages in connection with the execution of the contract and whose cause is attributed to parties other than the Bioromania.nl online store.
11.2 If the webshop bioromania.nl is held liable by third parties for this reason, the other party is obliged to assist the webshop bioromania.nl both in court and out of court and to immediately do everything possible expected from him in this case. If the other party does not take appropriate measures, the bioromania.nl online store is entitled to do so itself, without notice of non-compliance. All costs and damages incurred by bioromania.nl online store and third parties as a result are entirely at the expense and risk of the other party.
Article 12 Applicable Law and Disputes
13.1 All legal relationships to which the Bioromania.nl online store is a party are governed exclusively by Dutch law, even if an obligation is fulfilled in whole or in part abroad or if the party involved in the legal relationship is domiciled there. Applicability of the Vienna Sales Convention is excluded.
13.2 The parties will only go to court after they have made every effort to resolve a dispute by mutual agreement.
Article 13 Consent
13.1 When placing an order, bioromania.nl also receives permission from the other party to deliver a digital newsletter up to 4 times per month. The other party has the option to unsubscribe from receiving these newsletters at any time.
13.2 The other party agrees to receive an invitation within 14 days of the order to provide a review of the products ordered and the customer’s experience during the ordering process.
